Understanding the Divorce Process in England and Wales

Divorce can feel overwhelming. Especially if it’s your first time dealing with the legal system. We’re here to simplify the process and explain what you can expect at each stage.

The No-Fault Divorce System – What It Means for You

Since April 2022, couples in England and Wales no longer need to give a reason or assign blame when applying for divorce. This is known as the no-fault divorce system.

You can now apply:

  • Individually (as a sole applicant), or
  • Together (as joint applicants)

This modern approach helps reduce conflict, speeds up the process, and avoids unnecessary emotional strain — especially when children or shared finances are involved.

Key Stages in the Divorce Process

Here’s how divorce typically works in England and Wales:

  1. Application SubmittedOne or both spouses submit a divorce application to the court.
  2. Court Acknowledges ApplicationThe other party receives a copy and is asked to respond.
  3. Minimum Waiting PeriodThere’s a 20-week reflection period before you can apply for the next stage.
  4. Conditional Order IssuedPreviously called the Decree Nisi. This confirms that the court sees no reason why the divorce can’t proceed.
  5. Final Order GrantedThis is the final legal step that officially ends your marriage. It was previously called the Decree Absolute. Once granted, you are legally divorced.

How Long Does a Divorce Take?

On average, a divorce takes around 6 to 8 months from start to finish — assuming both parties cooperate and there are no major disputes.

Delays can happen if:

  • There are disagreements over children or finances
  • One party doesn’t respond promptly
  • The court backlog is high

Divorce FAQs – Quick Answers to Common Questions

Can I get a divorce without blaming my ex?

Yes. Since the introduction of no-fault divorce in England and Wales in April 2022, you no longer need to give a reason or blame your partner. You can apply as a sole applicant or make a joint application, which can help reduce conflict and make the process smoother.

How much does a divorce solicitor cost?

The cost depends on the complexity of your case. At MMA Law, we offer:

  • Fixed fees for straightforward divorces
  • Transparent pricing with no hidden charges
  • Bespoke quotes for more complex issues like financial settlements or child arrangements

We’ll explain all costs during your free 30-minute consultation.

Do I have to go to court for a divorce?

In most cases, no. You won’t need to attend court unless:

  1. There’s a dispute over children or finances
  2. Your ex contests the application
  3. Protective court orders are needed (e.g. non-molestation)

Many divorces are now processed online through the HMCTS portal with no hearings required.

What if my ex doesn’t agree to the divorce?

You can still apply as a sole applicant. The court will notify your ex (the respondent), and they will be given time to respond.

If they try to delay or ignore the process:

  • The court can still proceed with the divorce
  • Legal advice ensures delays are kept to a minimum
  • Your solicitor can take steps to move the case forward under no-fault rules

Can MMA Law help with urgent child contact issues?

Yes. We can act quickly if you're being denied contact or facing a threat to your parental rights. We offer:

  • Emergency applications for Section 8 Child Arrangement Orders
  • Legal representation in Middlesbrough Family Court
  • Advice on parenting plans and co-parenting disputes

What is a clean break order?

A clean break order is a legally binding agreement that ends financial ties between ex-spouses after divorce. It ensures:

  • No future financial claims
  • Finality and peace of mind
  • Protection for future assets or inheritances

MMA Law can help you draft or apply for a clean break order as part of your divorce.

Can unmarried couples get a divorce?

No, divorce applies only to legally married couples or civil partners. If you’re separating from a long-term partner, we can still help with:

  • Cohabitation disputes
  • Property ownership disagreements
  • Child arrangements and financial claims under Schedule 1 of the Children Act

Is Legal Aid available for divorce cases?

Legal Aid is limited but may be available in cases involving:

  • Domestic abuse or coercive control
  • Protection orders such as non-molestation or occupation orders
  • Mediation (in some financial or child-related disputes)

We’ll advise you during your consultation if you qualify and help with the application.

What documents do I need to start a divorce?

To begin the process, it’s helpful to have:

  1. Marriage certificate
  2. Basic details about your spouse (address, name)
  3. A clear idea of any children or financial assets involved

If you’re unsure or missing documents, we can still help you get started.
